When placing an order you automatically agree to our sales conditions, be aware of this and read them. Deviations from these conditions are of course possible, but only valid if they have been confirmed by us in writing.
1: General
These sales/purchase conditions apply to all orders and agreements for the sale, purchase of Products and Services by Mister-Hifi ('Seller'). These conditions exclude the applicability of all other conditions unless expressly agreed otherwise in writing with Seller.
2: Orders
Orders can only be placed verbally or by post, telephone or via internet mail. Unless expressly agreed otherwise, each offer from Seller will not be valid for longer than the validity period of the last applicable price list from the Netherlands. Special Products that we do not have as standard in our delivery program, which are therefore purchased and ordered exclusively for the customer, cannot be cancelled and the customer is obliged to accept them; if the Product is not available due to unforeseen circumstances, the Seller is entitled to deliver an equivalent Product at the discretion of the Seller, in consultation with the Customer. The Customer has the right to cancel under the conditions as stated in the conditions. These Products are therefore also ordered at the Customer's own risk and responsibility. Taking into account and not limited to (long) delivery times, color, deviations in models, etc.
3: Price
All prices listed include 21% VAT, unless otherwise stated. Used goods are not subject to VAT (margin scheme). Price excludes shipping, home delivery (customer location) and installation, unless otherwise stated on the invoice or agreed in writing.
4: Payment terms
Deliveries are made after advance payment. If delivery is with invoice, all deliveries with an invoice address in the Netherlands must be paid upon delivery (immediately). For deliveries abroad, advance payment is always required upon placing the order. If the permitted payment term is exceeded, the Customer will be in default from that moment on and will owe the statutory interest, in addition, the Customer is obliged to pay an amount of at least 15% of the principal sum as collection costs. All extrajudicial costs in the event of late payment are for the Customer. The Seller has the right to suspend further deliveries in the event of late payment.
5: Cancellation
And in case of sales on behalf Seller applies a repayment term of 30 days net after credit invoice date, without interest compensation. If the credit payment takes place later than 30 days due to unforeseen circumstances, we apply an interest compensation of statutory interest per year. Payments only concern actual payments from customer, trade-in value of goods is never reimbursed in cash. If your product has already been sold, another product will be offered, in consultation with customer or a credit note will be drawn up. Additional extra costs will not be reimbursed. Credit payment is at all times a service product. Seller is entitled to also supply stock products for this purpose to the value of the credit amount. Any additional costs due to unforeseen matters, but not limited to hidden defects (up to three months after sale by Seller) for Products supplied by Customer are for the account of Customer and will be invoiced to Customer. Seller reserves the right to offset outstanding invoices from the Customer. Used goods will not be taken back.
6: Delivery
Dates and terms of delivery are at all times only indicative. No rights can be derived from this. The Seller is not liable for deviations from this and it never gives the Customer the right to cancel the agreement. If the Customer wishes to cancel the agreement due to delayed delivery of specially ordered Products, 15% cancellation costs will be charged.
7: Retention of title
The Seller retains full and complete ownership of the Products until the entire payment due has been received. Until this time, the Customer is also not entitled to rent out, lend out or otherwise exploit the Products or to transfer them from its control. The Customer shall immediately inform the Seller of any alleged claim by third parties on the Products as long as they are the property of the Seller. The Customer shall store the Products that are subject to the retention of title carefully and clearly identifiable and clearly separated as Products of the Seller.
8: Inspection shipments
Mister-Hifi does not work with inspection shipments due to the current EU regulations regarding the law "Distance Selling". Mister-Hifi complies with this legislation. You may therefore return your product within 14 days if you do not keep it. Mister-Hifi will credit your payment to the specified account number within 30 days. Products that are not returned within this EU period are considered a final purchase and will not be taken back.
An exception to this are pick-up elements. Pick-up / record player elements are never returned!
9: Product information
The information on the website and provided by the Seller is only indicative and has been compiled in good faith. The Seller is therefore not liable for damage, injury, loss or costs resulting from any inaccuracy or error in this information. The Customer is solely responsible for ensuring that the Products ordered by him are suitable for the application(s) desired by him. Damage caused by incorrect use and deployment is excluded. Used goods are used and may bear any characteristics of use that are accepted as such by the Customer when placing the order; claims in this regard will not be accepted afterwards. In addition, there may be any malfunctions in the Products that are unknown to the Seller; no rights can be derived from this for the return of the Products, this also applies to any unseen "modifications" by previous owners.
10: Warranty on new products
If within two years after the invoice date the sold Product is defective in the opinion of the Seller, then, at the discretion of the Seller, the Product will be repaired free of charge, if necessary replaced by a universally equivalent interchangeable product. This guarantee does not apply in the event of incorrect or improper use of the Products, the assessment and ruling regarding incorrect or improper use lies with the seller after investigation and no further correspondence can be entered into about this. Modifications, opening of the purchased product is considered as intentional breach of the guarantee conditions. Any transport costs, additional import duties, etc. are for the Customer's costs. The Buyer must notify the Seller of this within 7 days after the defect has manifested itself, failing which no claim can be made under this guarantee.
11: Warranty on used equipment
Warranty (number of months is stated on your invoice) means that the device will be repaired by our technical service free of charge if possible, i.e. labor and parts will be reimbursed. Shipping costs are always for the Customer. If your device can no longer be repaired (technically or economically), you may select a replacement device from us of the same invoice value, minus the depreciation*. Shipping costs and installation costs on site (pick up and return) will be charged for repair or replacement. *Depreciation means 40% of the invoice value per year (deducted from the number of months that the equipment has been in your possession until notification). Repairs by third parties will not be reimbursed. Equipment that has been opened after purchase, the warranty will expire.
12: Return of a Product(s)
Seller is not liable for loss, delay or damage during transport of Products, even if the carrier has been chosen by Seller. Customer is therefore responsible for the correct insurance of the return shipment. Customer is deemed to have accepted the Products satisfactorily if no written complaint has been sent to Seller within 7 days of first delivery. A submitted complaint does not suspend Customer's payment obligation and Seller has a right to investigate the complaint. Customer has 7 days from the date of delivery to return Products. The reason for return shipment must be stated. Returns must always be made to the address specified by Seller. The costs for returning to Customer are always for the Customer's account. Products will only be accepted as returns if they are returned in the original packaging (whole and complete) and undamaged. Products that have been specially ordered / built for Customer cannot be cancelled without cancellation costs of 15% of the sales value. Customer can choose as an additional service to be reimbursed by means of a gift voucher worth the invoice amount. The right of return does not apply to used goods and unless this is expressly stated in writing and/or stated on the invoice. Any shipping costs (there and back) are for the Buyer. As described above, pick-up / record player elements are not taken back.
13: Sales on order
Seller can offer and sell products on behalf of Customer. The fee charged for this will be determined in writing and in consultation with the seller. The agreed fee applies per device. Warranty is given by Seller to Customer. However, if it appears that the devices delivered, during the test period, show defects at Mister-Hifi, these possible repair costs are for Customer. Payment to Customer takes place under the same conditions as the credit note under chapter payment conditions. Customer cannot cancel the first month, the order for sale, without costs. The cancellation costs amount to 100 Euro per device as so-called start-up costs. When returning the products, you must take 10 working days into account for the collection appointment. Credit payments take place in accordance with our payment conditions.
14: Exemption
Seller shall not be liable for any loss or damage (consequential or otherwise) suffered by Customer, its employees, representatives or third parties in the event of a failure to perform its obligations, defective Products or in other cases if it is not established that such loss or damage was caused by intent or gross negligence on the part of Seller.
15: Jurisdiction
Dutch law applies to all our sales and the above-mentioned conditions, both domestically and abroad. In the event of disputes, these will be submitted to the Zeeland-West-Brabant Court, Breda location.
16: Assigned Costs
Seller does not accept collection costs and other extrajudicial costs other than those entailed by mandatory law.
